Debt collection companies make mistakes. Records may not get updated, wrong phone numbers may be in computerized systems, or even mistaken identity can happen with people of similar names or in cases of identify theft. But just because a collection agency made a mistake, and you don’t actually owe the debt, doesn’t mean that they don’t have to follow the law regarding debt collection rules.
Rules apply in cases of debt collection by original creditors as well as third party collection agencies that have been hired to collect your debt or have purchased you debt. These rules make harassment, abuse, misrepresentation, and privacy violations punishable by statutory fines and payment of plaintiff’s fees. Types of debt include:
I offer free consultations for consumers who are victims of debt collection violations. I understand the law and how can apply to your situation. Put an end to your frustration, and contact my Los Angeles Law Office. When you call or email, you can be assured that I will personally respond and handle your issues with the dedication it deserves; I do not pass you off to paralegals or office staff - you will speak directly with me, an experienced lawyer.
For every violation of the FDCPA and/or Rosenthal Act, collection agencies may be fined $1000 - this money is part of the settlement to an affected consumer and in some cases tens of thousands of dollars was paid by a single company to person who suffered multiple incidences of harassment, abuse, privacy violations, or misrepresenation by debt collectors trying to collect on an alleged debt. Punitive damages may also be awarded to consumers. Importantly, payment of all attorney fees for successful claims are handled by the violating debt collection company. Therefore, when I take a on a case fighting for you, you do not need to pay any up-front fees, and unless I win your case, there are no attorney fees at all. You only pay me from money you recover from the debt collector that broke the law. This is called “no recovery, no fee”
If you are a being harassed by a debt collector’s illegal actions, methods, or tactics, for an alleged debt that you may not even owe to do paperwork error or even a case of identity theft, you should seek legal help.
