Harassed by Debt Collectors? A Los Angeles Lawyer to Help

Consumers Who Have Suffered Harassment Can Receive Monetary Compensation

If a company or a debt collection agency is violating your rights when they are trying to collect a debt, you may be able to bring legal action through a lawsuit. The law allows for you to recover money when your rights are violated by their harassing phone calls and letters.

As an attorney focused on helping people, I  founded the Leventhal Law Group in Los Angeles, CA. My experience as a bankruptcy lawyer, has given me insight to the methods debt collectors use. These methods can go beyond aggressive, and several laws (both federal statutes in the Fair Debt Collection Practices Act (FDCPA) and California state statutes in the Rosenthal Act) specify what debt collectors can and cannot do - and what specifies harassment.

Debt collectors may try to establish contact with you in efforts to collect a debt that they think you you owe. But you have certain legal  rights, and they must follow certain rules. It may be considered harassment when debt collectors:

Get Compensated for Harassing Behavior from a Debt Collector

The law does state the debt collectors may be made to pay you statutory damages of up to $1,000 for each violation against you, any actual damages you incurred, and your attorney's fees and costs. A written response to a debt collector is required to protect rights under the FDCPA and/or the Rosenthal Act.  Also, having a detailed written record of the actions of debt collectors is very important in building your case of their harassment of you. You may find useful forms and examples on this site for your reference and use.
