Federal law under the FDCPA protects consumers. 1. Ask you to pay more than you owe or misrepresent what you owe. This includes asking you to pay interest, fees, or expenses that are not actually allowed.
2. Harass you by:
3. Use or threaten to use violence against you or your family.
4. Threaten action they cannot or will not take, like criminal charges, wage garnishment, property repossession, job loss, or credit damage.
5. Disclose your alleged debt a third party, unless you have given them permission. Some exceptions may be:
6. Repeatedly call a third party (such as friends, family, or your employer) to get your location information, unless the debt collector has reason to believe the location you provided previously is false.
7. Contact you at work, knowing your employer doesn't approve.
8. Fail to send a written debt validation notice (with debt amount, creditor name, and your right to dispute with 30 days) within five days of their initial communication to you.
9. Ignore your written request to verify the debt and continue to collect without proper verification.
10. Continue their collection attempts after receiving a written cease communication notice from you. They may send you information about the debt and further actions possible.
